Filing a Certificate of Racial NondiscriminationFiling a Certificate of Racial Nondiscrimination
One of the most neglected federal reporting requirements.



  1. Background. Churches and other religious organizations that operate, supervise, or control a private school must file a certificate of racial nondiscrimination (Form 5578) each year with the IRS. The certificate is due by the 15th day of the fifth month following the end of the organization's fiscal year. This is May 15th of the following year for organizations that operate on a calendar year basis. This means that the Form 5578 for 2007 is due May 15, 2008.

  • Retiring Early. Thinking about retiring early? If so, you might be interested in a study conducted by the Social Security Administration's Office of Research, Evaluation, and Statistics. The study compared a population survey with SSA data, and found that men who retire early (at age 62) die sooner than men who retire at age 65 or older. The study results were consistent with a previous study looking at data from 1973.

How do you report a part-time pastor's salary entirly as housing income?


Richard HammarRichard Hammar is an attorney, CPA, and best-selling author specializing in legal and tax issues for churches and clergy. A graduate of Harvard Law School, he is the author of more than 100 books, including Pastor, Church & Law and the annual Church and Clergy Tax Guide. He also writes the Church Law & Tax Report and has contributed to numerous journals and publications.

Q: We have a part-time associate pastor who has asked the church to designate his entire salary as a housing allowance. Do we need to issue him a W-2 form at the end of the year reporting no income?

A: This is a surprisingly complex question. Here's why. Up until 1974, section 6051 of the federal tax code required a Form W-2 to be issued to (1) each employee from whom income, Social Security, or Medicare tax is withheld, or (2) each employee from whom income tax would have been withheld if the employee had claimed no more than one withholding allowance or had not claimed exemption from withholding on Form W-4. Churches were not required to issue a W-2 to pastors under this provision since their wages are exempt from tax withholding.

May 10
  • Churches having nonminister employees (or one or more ministers who report their federal income taxes as employees and who have elected voluntary withholding) may file their employer's quarterly federal tax return (Form 941) by this date instead of April 30 if all taxes for the first calendar quarter have been deposited in full and on time.
May 15
  • Unrelated business income tax return (Form 990-T) must be filed by this date by churches and any other organization exempt from federal income tax that had gross income from an unrelated trade or business of $500 or more in 2007.
